Probable cause was found and an arrest warrant ordered issued. He was arrested and booked into the St. Joseph County Jail earlier this morning on this arrest warrant, where he remains in custody at the issuance of this release. Troyae Scott appeared Tuesday afternoon before a St. Joseph County Magistrate for his initial bail hearing and arraignment. At that hearing, his bail was set at $5,000 cash or $50,000 Corporate surety. He has an initial hearing scheduled for February 5, 2020, at 9:00 a.m. before Judge Sanford.

On or about January 25, 2020 at approximately 11:32 p.m., South Bend Police Department (SBPD) officers responded to a shooting in the 1900 block of East Calvert Street, South Bend, St. Joseph County, Indiana.
Inside the residence officers found DeMarco Barnes with numerous gunshot wounds to his legs and abdomen. Mr. Barnes was transported to Memorial Hospital for treatment.

Later in the day on January 26, 2020, investigators went back to Memorial Hospital to speak with
DeMarco Barnes after he was out of surgery. Mr. Barnes explained that prior to the shooting, two individuals who he knows by the Facebook usernames “Buddy Folks” (later identified as Anthony Herron) and “Taliban Yae” came over to his house to smoke marijuana.

Mr. Barnes later showed investigators the “Taliban Yae” Facebook page and pointed out the individual who shot him to police. Officers identified that individual as Troyae L. Scott from previous law enforcement contacts.

In a further interview with Mr. Barnes , he stated that Herron arranged to come over to the residence to smoke marijuana. He stated that Troyae Scott came with Herron uninvited. Mr. Barnes said that he knows Troyae Scott as “Yaee” and has known him for around ten (10) years. He said that he and Troyae Scott have relative in common and that they refer to each other as “family.”

Barnes continued that when Herron and Troyae Scott came to his house, Mr. Barnes showed off his handgun to them. At some point, Troyae Scott took possession of the handgun and something to the effect of “This is mine now.” Mr. Barnes was not alarmed as he knew Troyae Scott well and believed this to be a joke. Troyae Scott then took an amount of marijuana and said something about it all being his now before walking toward the door.

Mr. Barnes said that he told Troyae Scott that he could not leave with these items.

Troyae Scott then shot Mr. Barnes. Mr. Barnes and Troyae Scott began to physically wrestle over the gun and Troyae Scott continued to shoot Mr. Barnes. Troyae Scott and Herron then fled. Police and medical crews arrived and rendered aid to Mr. Barnes.

Shortly after the shooting, Mr. Barnes’ first cousin Huey Hudson, Jr. became aware of the shooting and Troyae Scott’s role as the shooter. Hudson communicated with people at his brother, Marquise Scott’s,  home. (Marquise Scott is a relative of, but not a brother, to the other Scotts involved in this case). Hudson learned that three of Troyae Scott’s brothers were at Marquise Scott’s home. Hudson became angry and went to Marquise Scott’s home at 610 S. Liberty Street, in South Bend, to confront Troyae Scott’s brothers.

As stated previously, Barnes, Hudson, and all the Scotts are related in a fashion. Upon arriving at Marquise Scott’s home, Hudson was armed and confronted Troyae Scott’s brothers about Troyae shooting
Barnes. At the end of that confrontation, Hudson was arguing with Troyae Scott’s brother,
Troyon Scott. Troyon Scott shot Hudson multiple times, including two shots to the back of his
neck, which passed through Hudson’s neck and head, killing him.

South Bend Police responded and held the scene on S. Liberty for Metro Homicide to begin its investigation. During the course of the crime scene investigation, a marijuana growing operation was discovered in the basement of the home at 610 S. Liberty. Indiana State Police assisted in the investigation by taking control of the marijuana grow investigation. While some people involved in these investigations may have gang ties, strong evidence of gang motive has not been developed. The families of the victims have been updated on the investigations.

Please see attached Criminal Informations and Supplemental Affidavits in Support of Probable Cause.
The sentencing range for Murder is 45 to 65 years. A Firearm Sentencing Enhancement can add an extra 5 to 20 years to the conviction of the underlying offense.

The sentencing range for a Level 5 Felony is 1 to 6 years.
