No Charges Filed In Incident Involving Three Police Officers

Elkhart County Prosecuting Attorney Vicki Becker will file no criminal charges due to insufficient police response following a December incident involving three off-duty police officers, drinking and driving and gunshots.

On December 14 a Goshen police officer on traffic patrol heard gunshots on the Elkhart Road and County Road 17 overpass in Goshen. He followed a truck that came out from under the overpass and pulled it over.

The driver of the truck, Goshen police officer Brody Brown, was eventually arrested and charged with operating while intoxicated. He handed over his gun and it was found not to be the one that was fired.

The officer that pulled the truck over left the scene with Brown. The supervisor on scene Captain M. Miller questioned the two passengers Goshen police patrol division supervisor Kyle Kalb, and Elkhart police officer Leonard Dolshenko.

Miller then, according to a press release from Becker’s officer, quote-- ‘rather than securing the passengers and the truck to further the investigation, Captain Miller moved the truck from the roadway to a nearby parking lot and instructed Kalb and Dolshenko to get a ride home.’

Goshen Police Chief Jose Miller is holding a press conference Monday about the results of an internal investigation into the officers involved in the incident. Elkhart PD will be launching an internal investigation regarding Officer Dolshenko now that the county prosecutor's investigation has concluded.
